Maintenance Plan Terms and Conditions

Please read this document carefully and retain it for reference. These Terms and Conditions, together with your signed Agreement Page, constitute the full agreement (“Agreement”) between you and Frank Lee the Best Heating and Cooling LLC pertaining to the USA Maintenance Plan(s) purchased. The laws of Arizona govern the interpretation of this Agreement. Frank Lee the Best Heating and Cooling LLC (“Company”) may change the terms of, or add new terms to, the Plan at any time, in accordance with applicable law.

MANDATORY ARBITRATION NOTICE:
 This Agreement includes a binding Arbitration Clause with a Class Action Waiver. Please read it carefully.

What Is Covered

You are entitled to two scheduled maintenance visits per 12-month Annual Term by a certified technician. Services vary depending on the USA Plan tier selected.

Base Coverage

  • 5% discount on all repairs
  • 1-year warranty on non-serialized parts (excludes refrigerant)

Heating Unit (Furnace or Heat Pump):

  • Lubricate bearings, inspect heat exchanger
  • Clean/adjust burners and pilot, blower assembly
  • Inspect air filter, venting, safeties
  • Clear condensate line, monitor cycle, clean condenser coil

Cooling Unit (Central A/C):

  • Clean condenser coil
  • Check refrigerant levels, electrical connections, safety controls
  • Measure airflow, volts/amps, inspect ductwork
  • Test run capacitor, high-voltage connections, thermostat calibration

What Is Not Covered

  • Services not listed above
  • Replacement parts or refrigerant
  • Obsolete/unavailable parts
  • Damage due to abuse, flooding, power surges, fire, rust, mold, etc.
  • Preexisting or code-violating conditions
  • Hazardous materials or mold remediation
  • Unauthorized or third-party repairs
  • Non-responsiveness after 3 service scheduling attempts

Eligibility Requirements

Covered equipment must:

  • Be installed per all codes and manufacturer guidelines
  • Be readily accessible to technicians
  • Be located at residential-use properties (owned or rented)

The plan is valid for 12 months from the invoice date (“Effective Date”) and auto-renews annually unless canceled.

Note: A separate plan must be purchased for each heating/cooling unit.

How to Schedule Maintenance

  • You must call (520) 252-1966 to schedule service.
  •  Appointments are available Mon–Fri, 6:00 AM to 8:00 PM.
  •  Service must occur in weather between 60°F and 105°F.
  •  Failure to schedule voids eligibility for lifetime parts warranties.
  •  You must be current on all payments for coverage to apply

Term & Cancellation

  • 12-month term from Effective Date; auto-renews
  • Cancel anytime by calling (520) 252-1966
  • Full refund if canceled within 30 days and no service was performed
  • If canceled after service was rendered, you are responsible for remaining term
  • Plans can transfer to a new property if you move

Billing Terms

  • Annual billing, taxes/surcharges may apply
  • First charge occurs within 5 business days of Effective Date
  • Future charges occur on the same day each month
  • Your credit card or bill acts as your invoice
  • We reserve the right to change billing methods with notice

Late/Default Terms:

  • 2% monthly late fee on unpaid balances
  • Customer pays all reasonable collection, legal, and court costs
  • Service may be suspended if a payment method fails

Customer Responsibilities

  • Provide safe access to equipment
  • Notify us of system issues (noises, odors, humidity, spikes in bills, etc.)
  • Accept reminder calls/emails (but scheduling is your responsibility)
  • If you reject repair proposals, the plan may be voided
  • Modifications to your system must be reported for pricing adjustment
  • Adding new equipment increases your annual charge

Limit of Liability

Frank Lee the Best Heating and Cooling LLC:

  • Is not liable for indirect, punitive, incidental, or consequential damages
  • Limits liability to the value of the applicable annual plan
  • Is not the manufacturer and makes no implied product warranties

Arbitration Clause

All disputes must be resolved by binding individual arbitration unless eligible for small claims court. You waive the right to:

  • Sue in court
  • Jury trial
  • Class actions

Process:

  • Arbitration under AAA Consumer Rules
  • Location: federal district where you reside
  • Company pays arbitration fees
  • Arbitrator can award same remedies as a court
  • Arbitration clause survives contract termination
